DFARS 252.225-7002 Qualifying Country Sources as Subcontractors

Does the regulation require it to flow down?

No

The clause has only (a) and (b); there is no paragraph requiring its insertion in subcontracts. Primes include it to extend the non-exclusion rule to lower tiers and document 225.872 compliance across the whole chain.

A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

What it makes you produce

One item for your checklist.

  1. Nothing to send, ever

There is no paperwork here. It is a rule you follow while you perform the work.

    • A rule that runs while you place lower-tier work: an allied-country source is not shut out of a competition under the order, subject to the item-level restrictions the regulation names

      DFARS 252.225-7002(b)

When it is used

Accompanies DoD's Buy American/Balance of Payments regime (used together with 252.225-7001 in supplies contracts). Single obligation, in (b): subject to the DFARS 225.872 restrictions, the contractor may not exclude qualifying country sources or US sources from competing for subcontracts. Paragraph (a) carries the current list of 28 qualifying countries (Australia, Germany, United Kingdom, Japan, Israel, Canada, Turkey, etc. — countries with defense MOUs with the US). The clause ends at (b): there is no flow-down paragraph.

Read closely

the clause has only (a), the list of qualifying countries, and (b), the rule. It names no record, so a purchasing file showing who was invited, who quoted and why the winner won is evidence rather than a deliverable.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
