What it makes you produce
4 items for your checklist, slowest first.
Something you write2
Days to weeks, and nobody outside your company has to agree to it.
- FAR 52.222-50(h)
A compliance plan sized to the work — awareness programming, a reporting route to the hotline at 1-844-888-FREE, recruitment and wage procedures that charge workers no fees, housing that meets host-country standards, and procedures to keep agents and lower-tier suppliers out of the prohibited activity
Owed when more than $700,000 of the work is supplies other than commercially available off-the-shelf items acquired outside the United States, or services performed outside the United States
Notice to your employees and agents of the prohibited activities and of what a violation costs
FAR 52.222-50(c)(1)
Something you fill in and send back2
Hours, once you know which one is missing.
- FAR 52.222-50(h)(5)
A certification to the buyer, at award and once a year after that, that the plan is implemented and that after due diligence nothing prohibited was found — or that remedial and referral action was taken
Owed when the same $700,000 outside-the-United-States portion that brings the plan with it
- FAR 52.222-50(d)(1)
An immediate report to the buyer and to the agency inspector general, naming the action taken against whoever was responsible
Owed when you receive credible information that an employee, agent or subcontractor has engaged in the prohibited conduct
When it is used
ALL contracts, including commercial/COTS, any value. Compliance plan + annual certification: only for a > $700,000 portion of non-COTS supplies acquired outside the US or services performed outside the US.
Read closely
The first two rows carry a threshold the clause's own applicability does not: paragraph (h) attaches the plan and the annual certification only above $700,000 of non-COTS supplies acquired outside the United States or services performed outside it, while the prohibitions and the employee notice ride at any value, commercial and off-the-shelf buys included. For an operation wholly inside the United States the cost is an internal policy and training. Paragraph (i)(1) puts the substance, including itself, into all subcontracts and into all contracts with agents.
Alternates
Alt I · MAR 2015
FAR 22.1705(a)(2) — the CO knows of specific directives or notices applicable to performance outside the US.
Alternate I substitutes paragraph (c)(1) so the employee notice carries the specific anti-trafficking directives for the overseas performance locations, listed by the contracting officer in a table inside the clause; the notice is still the same thing you write and hand out, with different content in it.

Source: acquisition.gov, FAR 52.222-50, codified text read at FAC 2026-01 (effective 2026-03-13), prescribed at 22.1705(a)(1) with designation (Oct 2025) and Alternate I (Mar 2015); the RFO Part 52 disposition table prescribes it at 22.1703-2(a)(1) and prints (Deviation Date), so the model text is rewritten rather than carried over (verified 2026-08-09)
This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
