DFARS 252.225-7031 Secondary Arab Boycott of Israel

Does the regulation require it to flow down?

No

The provision never mentions subcontracts. It is a certification by an offeror to the Government at the solicitation stage; there is no paragraph directing anyone to insert it in a lower-tier instrument, and DFARS 225.76 contains no flow-down direction. Primes carry it anyway for two reasons: their master flow-down matrices are built by copying the DFARS 252.225 range wholesale rather than by prescription, and a prime that certifies non-participation in the boycott wants a matching representation from its supply base so its own certification is not undermined from below. Note the phase defect this produces: two of the three corpus documents carrying it (ICRC T&M subcontract 2005, CACI labor-hour subcontract 2020) are EXECUTED subcontracts, not solicitations — a solicitation-stage certification cannot be performed inside a signed agreement, and its appearance there is a template defect.

A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

    • The boycott certification, made by submitting the offer rather than on a signature line

Owed when the offeror is a foreign person — anyone other than a United States resident or national, a domestic concern, or a foreign subsidiary or affiliate controlled in fact by a domestic concern

When it is used

A solicitation provision, not a contract clause. DFARS 225.7605 prescribes it, unless an exception at 225.7603 or a waiver under 225.7604 applies, in ALL solicitations, including solicitations using FAR part 12 procedures — no dollar threshold. 225.7605 also directs that if the solicitation includes FAR 52.204-7 (System for Award Management), the contracting officer does not separately list 252.225-7031, because the representation is collected through the offeror's SAM annual representations. The certification in paragraph (b) is made only by an offeror that is a 'foreign person' — anyone other than a United States person as defined in 50 U.S.C. App. 2415(2), which covers US residents and nationals, domestic concerns, and foreign subsidiaries or affiliates controlled in fact by a domestic concern. Statutory driver per DFARS 212.301(f): 10 U.S.C. 4659.

Read closely

Where FAR 52.204-7 is in the solicitation, DFARS 225.7605 directs that this provision is not listed separately, because the representation already sits in the annual SAM record. The operational side is documentary: a letter of credit, purchase order or shipping document asking you to state that goods are not of Israeli origin, that no Israeli-flag vessel will be used, or that your firm is not blacklisted, is the boycott. Separate Commerce Department antiboycott reporting rules run on boycott requests independently of this provision.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
