FAR 52.236-13 Accident Prevention

Does the regulation require it to flow down?

Yes

Every subcontract. Paragraph (e) sets no dollar threshold, no work-type filter and no exception, so the SAT test in 36.513(a) governs whether the clause enters the prime contract, not how far down it goes once it is there. This is the only clause in this batch with a regulatory flow-down mandate.

Form
verbatim (without alteration) — paragraph (e): 'The Contractor shall insert this clause, including this paragraph (e), with appropriate changes in the designation of the parties, in subcontracts.'
Reaches
all tiers — (e) requires inserting (e) itself, so the obligation regenerates at every level

What it makes you produce

2 items for your checklist, slowest first.

  1. A program you have to be running2

You are either running it or you are not, and what the prime asks for is the date it started.

    • Work environments and procedures that safeguard the public, Government personnel and Government property exposed to the operation, avoid interrupting Government operations or delaying the project completion dates, and control the cost of performance

      FAR 52.236-13(a)
    • On construction, dismantling, demolition or removal work for a Defense agency, a site run to the Corps of Engineers manual EM 385-1-1 in effect on the date of the solicitation

      FAR 52.236-13(c)

When it is used

FAR 36.513 has two independent doors. (a) Fixed-price construction, or fixed-price dismantling, demolition, or removal of improvements, expected to exceed the simplified acquisition threshold ($350,000 since 2025-10-01) — mandatory; at or below the SAT the contracting officer MAY insert it, and Alternate I shall be used where the work is of long duration or a hazardous nature. (b) Services at Government facilities under Part 37, when technical representatives advise that special precautions are appropriate — that door carries no contract-type restriction and no dollar threshold, which is why the corpus shows the clause flowed into cost-reimbursement and time-and-materials masters (Northrop's CR and T&M templates) alongside the FFP one. Paragraph (c) of the clause adds the DoD layer: on construction, dismantling, demolition or removal work for any DoD agency or component, comply with the latest version of the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of the solicitation.

Read closely

(b) adds the specifics on that class of work — barricades, signs and signal lights, the Secretary of Labor's standards at 29 CFR parts 1926 and 1910, and whatever further measures the contracting officer determines reasonably necessary. (d) is the sharp end: after an oral notice confirmed in writing, failure to take prompt corrective action lets the buyer stop all or part of the work, and the clause states in terms that there is no price adjustment and no schedule extension for that stop. EM 385-1-1 is several hundred pages and the edition is fixed at the solicitation date.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
