What it makes you produce
2 items for your checklist, slowest first.
Something somebody else has to issue you
The same day if the issuer is one of your own suppliers, months if it is an assessor or an underwriter.
The contracting officer's written consent, given before any litigation information goes to an entity outside your organization
DFARS 252.204-7014(b)(2)
Something you write
Days to weeks, and nobody outside your company has to agree to it.
Your employees placed under use and nondisclosure obligations consistent with the clause before any of them is given access to the litigation information — (e) requires the obligation and leaves you the instrument
DFARS 252.204-7014(e)
When it is used
All solicitations and contracts that involve litigation support services, including those using FAR part 12 procedures for commercial products and commercial services (204.7403(a); carried forward unchanged by DoD Class Deviation 2026-O0043, effective 2026-02-17). No dollar threshold, no COTS exception. 'Litigation support' is defined in the clause as administrative, technical, or professional services provided in support of the Government during or in anticipation of litigation — narrower than the templates suggest, and L3Harris states the condition on the line.
Read closely
(b)(5) closes it out: on completion of the authorized litigation support activities the information is destroyed, or returned to the Government at the contracting officer's request. (b)(1) and (b)(4) are use restrictions rather than paperwork — the information is accessed and used only to provide litigation support under this contract, and never to compete against a third party. (f) carries the substance into all of your own orders, commercial ones included.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
