DFARS 252.225-7053 Representation Regarding Prohibition on Use of Certain Energy Sourced from Inside the Russian Federation

Does the regulation require it to flow down?

No

252.225-7053 carries no flow-down paragraph. It is a representation made by the offeror to the Government at proposal, and its paragraph (c) reaches subcontracts only in the sense that the offeror represents it will not use Russian-sourced energy 'in the performance of any contract, subcontract, or other contractual instrument resulting from this solicitation' — that is the scope of the offeror's own promise, not a direction to insert anything below. The flow-down mandate lives in the PAIRED CLAUSE 252.225-7054 (JAN 2023), whose paragraph (c) requires the Contractor to insert the substance of that clause, including paragraph (c), in subcontracts and other commercial instruments that are for furnished energy at a covered military installation, including instruments for commercial products. So: -7053 belongs to whoever is submitting an offer to the Government; -7054 is what a subcontractor supplying furnished energy should actually receive. All three General Dynamics Mission Systems templates dated 2026-07-20 carry both, with -7053 correctly placed in their 'Applicable to Solicitation' block and -7054 in the clause block — which is the right split; a template that flowed -7053 alone would be flowing the wrong instrument.

A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

    • The representation, made by submitting the offer, that no energy sourced inside the Russian Federation will be used or provided as the means of generating the energy you furnish under any resulting instrument

When it is used

A solicitation provision, not a contract clause — and the distinction is the whole entry. DFARS 225.7019-4(a) prescribes 252.225-7053 in SOLICITATIONS for the acquisition of furnished energy for a covered military installation; 225.7019-4(b) prescribes the paired CLAUSE 252.225-7054 in solicitations AND contracts for the same acquisitions. Both apply unless a waiver has been granted under 225.7019-3. Statutory base is section 2821 of the FY 2020 NDAA (Pub. L. 116-92). Per 225.7019-1, 'covered military installation' means a military installation in Europe identified by DoD as a main operating base; 'main operating base' means a facility outside the United States and its territories with permanently stationed operating forces and robust infrastructure; 'furnished energy' means energy furnished to such an installation in any form and for any purpose, including heating, cooling, and electricity. There is no dollar threshold, and the prescription reaches FAR part 12 and simplified-acquisition buys. The prohibition covers all forms of energy furnished to the installation, but not energy a third party converts into another form and does not deliver directly to the installation. Anything outside the acquisition of furnished energy for a European main operating base is outside both instruments entirely.

Read closely

Paragraph (b) is the prohibition the representation answers to, and its second half leaves out energy a third party converts into another form and does not deliver directly to the installation. The provision reaches the acquisition of furnished energy for a covered military installation — a Department of Defense main operating base in Europe — and nothing else; supplying equipment, fuel handling services or an energy-consuming product is not furnished energy. Waivers under DFARS 225.7019-3 are a Government action rather than something a supplier obtains. The instrument that binds a lower tier is the clause, DFARS 252.225-7054(c).

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
