DFARS 252.225-7055 Representation Regarding Business Operations with the Maduro Regime
Does the regulation require it to flow down?
No
The provision contains no subcontracts paragraph and DFARS 225.7020-5(a) prescribes it for solicitations only. What actually reaches subcontractors is the companion clause 252.225-7056 (already in this base). Primes still copy the provision into flow-down packages because they need the sub's representation on file to support their own representation to the Government, and because most templates reproduce the DFARS 252.225 block as a single list without separating solicitation instruments from contract clauses — BAE's USGovA FAR/DFARS flow-down (Mar 2025) lists it inside an undifferentiated clause block, while GDMS SCM-TMP-005/-048/-095 (2026-07-20) correctly park it under 'FAR/DFARS Clauses — Applicable to Solicitation'.
A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

The representation, made by submitting the offer, either that you have no business operations with an authority of the Maduro regime or a government of Venezuela the United States does not recognize as legitimate, or that you hold a valid license to operate in Venezuela issued by the Office of Foreign Assets Control

When it is used
DFARS 225.7020-5(a): use the provision in solicitations, including solicitations using FAR part 12 procedures for commercial products and commercial services, that include the clause at 252.225-7056. No dollar threshold, no commercial carve-out, no place-of-performance test — the only gate is whether the companion clause 252.225-7056 is in the solicitation, which it is unless the 225.7020-3(b) exception applies or a Secretary of Defense / Secretary of State joint determination has been made under 225.7020-4. Reprinted without change by Class Deviation 2026-O0041, Rev. 1 (1 July 2026).
Read closely
The definitions it turns on — business operations, and agency or instrumentality of the government of Venezuela — are in the companion clause DFARS 252.225-7056 rather than here, so that is what to read before ticking the box. It is a statement about your own operations rather than about your supply chain, and it is made every time you quote. Ownership records, the license and screening results are what the answer stands on if it is contested.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
