DFARS 252.225-7057 Preaward Disclosure of Employment of Individuals Who Work in the People's Republic of China

Does the regulation require it to flow down?

No

The provision has no subcontracts paragraph and 225.7021-4(a) prescribes it for solicitations only. It nevertheless reaches subs through the definition rather than through a flow-down mandate: 225.7021-1 defines 'covered contract' to include subcontracts above $5M, so a prime that must report cannot report without asking its >$5M subs the same question. That is why L3Harris LGL-50 F1 (Feb 2026) carries it with the condition 'applies if the solicitation includes DFARS 252.225-7058', and why BAE (Mar 2025) and GDMS (2026-07-20) list it at all.

A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

What it makes you produce

One item for your checklist.

  1. Something you fill in and send back

Hours, once you know which one is missing.

    • The disclosure filed with your offer — that a workforce in China is proposed, how many people, and the street addresses where the work happens

Owed when the subcontract is over $5 million, is not for commercial products or services, and one or more people will perform work on it in China

When it is used

DFARS 225.7021-4(a): use the provision in solicitations that include the clause at 252.225-7058. The real gates live in the 225.7021-1 definitions: a 'covered contract' is any DoD contract OR SUBCONTRACT with a value in excess of $5,000,000, not including contracts for commercial products and commercial services; a 'covered entity' is an entity performing work on a covered contract in the People's Republic of China, including by leasing or owning real property used there for that performance. Because the definition names subcontracts, the $5M test is applied at YOUR subcontract value, not only at the prime's. Important as of 2026-08-05: Class Deviation 2026-O0041, Revision 1 (2026-07-01) removes 225.7021 and reserves both 252.225-7057 and 252.225-7058, so no DoD contracting officer is currently prescribed to use it, even though the codified text remains on acquisition.gov.

Read closely

(b) is the bar on award without it, and there is no waiver anyone can grant themselves. The disclosure travels on to the pricing and contracting policy office, so those street addresses leave the prime.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
