DFARS 252.225-7059 Prohibition on Certain Procurements from the Xinjiang Uyghur Autonomous Region-Representation

Does the regulation require it to flow down?

No

The provision has no subcontracts paragraph; 225.7022-5(a) prescribes it for solicitations only. The instrument that actually binds lower tiers is the companion clause 252.225-7060 (already in this base), whose paragraph (c) requires insertion 'without alteration other than to identify the appropriate parties' in subcontracts including those for commercial products, commercial services, and COTS items. Primes carry the representation into flow-down packages anyway because their own good-faith-effort statement is only as good as what their suppliers told them — L3Harris LGL-50 F1 and F2 (Feb 2026) both condition it on 'applies if the solicitation includes DFARS 252.225-7060'.

A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

    • The representation, made by submitting the offer, that a good faith effort was made to determine that forced labor from the Xinjiang Uyghur Autonomous Region will not be used in performing the resulting contract

When it is used

DFARS 225.7022-5(a): use the provision in solicitations, including solicitations using FAR part 12 procedures for the acquisition of commercial products, commercial services, and COTS items, that contain the clause at 252.225-7060. No dollar threshold and no commercial or COTS carve-out — the widest reach of any instrument in this batch. The companion clause 252.225-7060 is itself prescribed for solicitations, contracts, and orders for products utilizing funds appropriated or otherwise made available for any fiscal year (225.7022-5(b)). Reprinted without change by Class Deviation 2026-O0041, Rev. 1 (1 July 2026).

Read closely

Paragraph (b) is the prohibition on the Department of Defense that the representation answers to. Good faith effort is not defined, so the record is what the answer stands on: written supplier declarations covering that labor, country-of-origin and smelter data on the materials you buy, screening against the forced labor entity list, and a documented escalation path where a supplier will not answer. The reach is wider than goods made in the region — it covers products mined, produced or manufactured wholly or in part with that labor, and products from an entity that used labor transferred out of it. No dollar floor and no off-the-shelf exception, so a $2,000 order can carry it. The clause that binds a lower tier is DFARS 252.225-7060(c).
