FAR 52.222-19 Child Labor-Cooperation with Authorities and Remedies

Does the regulation require it to flow down?

No

No flow-down paragraph in the text (verified); primes include it because the sanctions reach products manufactured/mined with forced child labor at any point in the chain — flowing the clause down extends to the sub the cooperation and access duty the prime promised the government

A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

What it makes you produce

One item for your checklist.

  1. Something you write

Days to weeks, and nobody outside your company has to agree to it.

    • Reasonable access to records, documents, persons or premises, for officials of the contracting agency, the Department of the Treasury or the Department of Justice

Owed when those officials make a reasonable request in an investigation into forced or indentured child labor

      FAR 52.222-19(b)

When it is used

Prescription 22.1505(b) (verified): every supplies contract above the micro-purchase threshold ($15,000). The text itself exempts end products from trade agreement countries above per-country bands: Israel > $50,000, Mexico > $105,767, and a group of 29 countries > $174,000.

Read closely

Paragraph (b) is a duty to cooperate that produces nothing until somebody asks, and the heading over it does not quite fit: nobody authors premises access, and there is no heading here for what you hand over on demand, so it is grouped with the things you write. The clause has no report, no certificate and no insertion paragraph. Where your product is on the Executive Order 13126 list, the certification is a separate instrument at FAR 52.222-18, and origin records are what it stands on. The text exempts end products from trade agreement countries above the per-country bands it lists.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
