What it makes you produce
3 items for your checklist, slowest first.
A program you have to be running
You are either running it or you are not, and what the prime asks for is the date it started.
A listing practice, running for the life of the contract: every employment opening listed immediately with the appropriate employment service delivery system, and at least concurrently with any other recruitment source or effort you use
41 CFR 60-300.5(a)(2) and (a)(3), which FAR 52.222-35(b) makes a term of your contract
Something you write2
Days to weeks, and nobody outside your company has to agree to it.
The notices in the form the Director prescribes, posted in conspicuous places available to employees and applicants for employment
41 CFR 60-300.5(a)(9), which FAR 52.222-35(b) makes a term of your contract- 41 CFR 60-300.5(a)(10), which FAR 52.222-35(b) makes a term of your contract
Notice to each labor organization or representative of workers that you are bound by the terms of the veterans' statute
Owed when you have a collective bargaining agreement or other contract or understanding with a labor organization or representative of workers
When it is used
Contracts ≥ $200,000 (was $150k until 2025-09-30). Statutory (38 U.S.C. 4212) — unaffected by the revocation of EO 11246.
Read closely
The FAR clause itself is short — paragraph (b) adopts the equal opportunity clause at 41 CFR 60-300.5(a) as of 2014-03-24, and every row here is cited to the paragraph of that adopted clause rather than to the FAR sentence that adopts it. The listing is a continuing duty rather than a one-time filing, which is why it sits in the band it does. The annual report on protected veterans is a separate clause, FAR 52.222-37. This one rests on 38 U.S.C. 4212 and was not affected by the revocation of Executive Order 11246. Paragraph (c) carries the terms into subcontracts at or above the FAR 22.1303(a) threshold, $200,000 since 2025-10-01.
The 22 templates that name it, with the line
Source: acquisition.gov, FAR 52.222-35, codified text read at FAC 2026-01 (effective 2026-03-13), prescribed at 22.1310(a)(1) with designation (Jun 2020) and Alternate I (Jul 2014); the RFO Part 52 disposition table prescribes it at 22.1302-2(a)(1) and prints (Deviation DATE), so the model text is rewritten rather than carried over (verified 2026-08-09)
This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
