FAR 52.222-20 Contracts for Materials, Supplies, Articles, and Equipment

Does the regulation require it to flow down?

No

No flow-down paragraph in the text (verified) — the statute's obligation falls on whoever holds the covered contract; primes paste the entire 52.222 block into the PO by template, not by prescription

A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

What it makes you produce

2 items for your checklist, slowest first.

  1. Nothing to send, ever2

There is no paperwork here. It is a rule you follow while you perform the work.

    • Wages at or above the rate prescribed under 41 CFR 50-202.2 for all employees whose work relates to the contract

      FAR 52.222-20(b)
    • The other stipulations of 41 U.S.C. chapter 65 that paragraph (a) incorporates by reference — no minors and no convict labor in producing what you deliver, and workplaces that are safe and sanitary

      FAR 52.222-20(a)

When it is used

Contracts for materials, supplies, articles, and equipment above the 22.602 threshold — $20,000 in the current text (verified) — entered with manufacturers or regular dealers, performed in the US. Incorporates by reference the stipulations of 41 U.S.C. chapter 65.

Read closely

The clause is two paragraphs long and asks for no submission, no notice and no report; the detail sits in the statute and in 41 CFR chapter 50 rather than in the clause. Formal exceptions for apprentices, learners and workers with disabilities run through section 14 of the Fair Labor Standards Act. A shop already compliant with that Act and with occupational safety rules is largely covered here; the exposure sits with informal suppliers.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
