Boeing GP9 — General Provisions, Labor Hour/T&M Contract under U.S. Government Prime Contract

Its 6 clauses can ask you for 13 things.

  1. A program you have to be running1e.g. A system of internal controls that manages the Government property in your shop FAR 52.245-1(b)(1)

You are either running it or you are not, and what the prime asks for is the date it started.

    • A system of internal controls that manages the Government property in your shop — control, use, preservation, protection, repair and maintenance

      FAR 52.245-1(b)(1)
  2. Something you write7e.g. The final termination settlement proposal within one year FAR 52.249-6(f)

Days to weeks, and nobody outside your company has to agree to it.

    • An adequate final indirect cost rate proposal within the six months following the expiration of each of your fiscal years

      FAR 52.216-7(d)(2)(i)
    • Written notice when the running total will pass 85 percent of the ceiling price

      FAR 52.232-7(d)
    • Property records for everything accountable to the order, carrying the data elements the clause names

      FAR 52.245-1(f)(1)(iii)

    • Physical inventories performed, recorded and disclosed on a stated cycle

      FAR 52.245-1(f)(1)(iv)
    • A report on every loss of Government property, recognized, investigated and disclosed

      FAR 52.245-1(f)(1)(vii)
    • Complete termination inventory schedules within 120 days of the effective date

      FAR 52.249-6(d)
    • The final termination settlement proposal within one year — on cost-type work the incurred costs come back either way, and the fee is what the settlement turns on

      FAR 52.249-6(f)
  3. Something you fill in and send back2e.g. Interim vouchers billed against incurred cost FAR 52.216-7(a)

Hours, once you know which one is missing.

    • Interim vouchers billed against incurred cost

      FAR 52.216-7(a)
    • Vouchers no more often than every two weeks, billing hours by labor category at the contract's fixed hourly rates and materials at allowable cost

      FAR 52.232-7(a) and (b)
  4. Nothing to send now3They are terms that decide what money moves later.
Research, not legal advice. Also: this reads FAR and DFARS clause numbers. It reads nothing else in your document. What that leaves out

It says nothing about indemnity, insurance, limits of liability, governing law, payment terms, warranty terms, or the dates you owe the prime. None of that is FAR. None of it is ruled here. It is often the part that costs money.

Also from Boeing

Research, not legal advice. It does not rule on whether Boeing's markings are correct, and a clause with no flow-down mandate in the regulation is still a contract term once it is in your subcontract.
