DFARS 252.225-7052 Restriction on the Acquisition of Certain Magnets, Tantalum, and Tungsten

Deviation number 252.225-7961. DoD Class Deviation 2026-O0041 rewrites DFARS part 225 for the FAR overhaul. It prescribes 252.225-7961 in place of 252.225-7052, so a document written under it can cite 252.225-7961 instead. The two texts can differ. The source at the foot of this page says how.

Does the regulation require it to flow down?

Yes

What it makes you produce

One item for your checklist.

  1. Something somebody else has to issue you

The same day if the issuer is one of your own suppliers, months if it is an assessor or an underwriter.

    • An origin declaration from the supplier of each covered material — samarium-cobalt and neodymium-iron-boron magnets, tantalum, tungsten powder, and tungsten heavy alloy — naming where it was melted or produced, and the prime asking for it sets what is enough

      DFARS 252.225-7052

When it is used

Contracts above the SAT ($350K), including FAR part 12, except acquisitions outside the US for use outside the US or a nonavailability determination (prescription 225.7018-5). Covered materials: samarium-cobalt and neodymium-iron-boron magnets, tantalum (metal and alloys), tungsten powder, and tungsten heavy alloy (including finished/semi-finished components containing them).

Read closely

(b) bars covered material melted or produced in China, Russia, Iran, or North Korea, and from 2027-01-01 it reaches mining, refining and separation as well, by a test that differs by regime: the codified 252.225-7052 (MAY 2024) reaches every delivery from that date, and Class Deviation 2026-O0041's 252.225-7961 (JUN 2026) reaches only contracts awarded on or after it. That date is what any supplier requalification runs against. (c) carries the exceptions, among them recycled neodymium-iron-boron magnets milled and sintered in the United States. No paragraph of the clause names a declaration.

CODIFIED REGIME, read 2026-11-04 at DFARS Change 5/7/2026: 225.7018-5 reads "use the clause at 252.225-7052, Restriction on Acquisition of Certain Magnets, Tantalum, and Tungsten, in solicitations and contracts, including solicitations and contracts using FAR part 12 procedures", and the clause head reads "As prescribed in 225.7018-5, use the following clause:" with designation (MAY 2024). DEVIATION REGIME: acq.osd.mil, DoD Class Deviation 2026-O0041, Revision 1 (DFARS part 225), signed 2026-07-01, which "revises and supersedes Class Deviation 2026-O0041, issued on February 3, 2026". Its Attachment A1 carries this clause under the number 252.225-7961: 225.7018-5 reads "insert the clause at 252.225-7961, Restriction on Acquisition of Certain Magnets, Tantalum, and Tungsten" under the same conditions, the clause is designated (JUN 2026) (DEVIATION 2026-O0041), and 252.225-7052 appears in Attachment A1 zero times. The acquisition.gov mirror, acquisition.gov/sites/default/files/page_file_uploads/DoD_RFO_Deviation_Part-25.pdf (2008971 bytes, 272 pages), is still the superseded 2026-02-03 issue and prints 252.225-7052 at 225.7018-5, so it does not carry this regime.
