FAR 52.215-20 Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data
Does the regulation require it to flow down?
No
No flow-down paragraph. Primes reuse the provision in subcontract RFQs because it is the standard vehicle for requesting cost data from the sub — which the prime needs to pass on to the government by force of 52.215-12/-13. Presence in a template ≠ prescription.
A clause can reach your subcontract without a mandate. Once it is in your document, it is a contract term all the same. The missing mandate is a fact about the regulation. It is not a ruling on your order.

When it is used
A SOLICITATION provision (15.408(l)): enters when it is reasonably certain that cost data — certified or not — will be required. It reaches the sub when the prime reuses it in the subcontract RFQ to structure the data request. Certified data: above the TINA threshold ($2.5M) with no exception; 'data other than' can be requested below that. (Trigger corrected 2026-08-05, backlog item 12: the entry gated on the dollar threshold and `commercial == false` and stopped there, so a non-commercial order above the threshold came out `applies` — deciding a question 15.408 leaves to 15.403-1(b). The family was also inconsistent with itself: 52.215-11 and 52.215-21 carried a structural leg for this and 52.215-10, -12, -13 and -20 did not. Prescription verified against acquisition.gov, FAR 15.408.)
Read closely
Paragraph (a)(2) opens the books to examination at any time before award, for verifying an exception request. This is a solicitation instrument, and its presence in a template is not a prescription.

Alt II · OCT 1997
FAR 15.408(l).
Alt II adds a paragraph (c) about where the copies go — one to the administrative contracting officer and one to the contract auditor, on top of the standard submission. The package itself is the one paragraph (b) already asks for.

This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
