- 52.244-6(c)(1)
The flow-down list your own orders have to carry — the clauses at paragraph (c)(1), which is the whole of what this clause requires
Owed when you place a subcontract of your own for commercial products or commercial services
When it is used
FAR 44.403 puts this clause in contracts other than those for commercial products or commercial services, so it sits in a non-commercial contract one level up. Paragraph (d) then carries it into every subcontract awarded under that contract, whether or not what you sell is commercial. What the clause defines is the exhaustive list, at paragraph (c)(1), of what must go into a subcontract for commercial products or commercial services. No threshold.
Read closely
Paragraph (c)(2) is permissive and says so: while not required, the contractor may flow additional clauses down, kept to the minimum necessary — so anything past the (c)(1) list is the buyer's choice rather than the regulation's. Paragraph (d) put this clause in your hands whether or not what you sell is commercial. Under the model text DoD contracting officers have used since 2026-02-01 the list sits at paragraph (b)(2) with different membership, so the regime has to be named before the list is read.

Source: acquisition.gov, FAR 52.244-6 and 44.403 — paragraph (d) and the 44.403 prescription both read verbatim 2026-08-07, and both re-read at FAC 2026-01 (effective 2026-03-13) with designation (Oct 2025); the RFO Part 52 disposition table keeps the 44.403 prescription and prints (DEVIATION DATE), so the model text is rewritten rather than carried over (verified 2026-08-09)
This is research, not legal advice. It states what the regulation says about this clause and cites the paragraph behind it. It does not rule on your order, and it does not rule on whether a prime's markings are correct.
